OWNER LEGAL TEXT PENDING — FOR OWNER AND COUNSEL REVIEW ONLY. NOT LEGAL ADVICE. DO NOT PUBLISH AS APPROVED TEXT.
Effective date for each document: [OWNER INPUT: EFFECTIVE_DATE].
B. Terms of Service — DRAFT
B1. Agreement and documents
These Terms govern use of OperatorRank provided by [OWNER INPUT: LEGAL_ENTITY_NAME], at [OWNER INPUT: REGISTERED_ADDRESS]. The approved effective date is [OWNER INPUT: EFFECTIVE_DATE]. By creating an account or using the service after being presented with these Terms, you agree to the applicable Terms. The Privacy and Cookie Policies explain data processing; acknowledging them is not blanket consent to optional processing.
Review note: verify the actual acceptance presentation/record and counsel’s required version/change process. No acceptance receipt is certified by this draft. Thai and English are companion drafts; the controlling language and treatment of discrepancies remain an owner/counsel decision.
B2. Eligibility and account care
You must be at least 18 and have the legal capacity or legally valid authorization required to enter this agreement in your jurisdiction. Use one individual account per person and provide accurate information. Keep credentials private and do not let someone else perform an assessment as you. Notify support if your account may have been compromised. Responsibility for activity depends on the facts and applicable law; this clause does not automatically make you liable for every unauthorized act.
If you act for an organization, you must have authority for the actions you take. Any separate organization agreement and data-processing terms require their own approval; this draft does not invent them.
B3. Service, beta and mission limits
OperatorRank provides mission workspaces, AI assistance and checks/evidence/results for features made available to your account. The service is in open beta; features and availability may change, be limited or be paused. Missions have stated time, credit, AI-budget, tool and resource limits. Review the briefing and charges shown before starting. AI use and checks are limited to the environment and permissions provided for that mission.
Automated checks and AI assistance do not guarantee that code is secure, correct or fit for use, that an assessment is error-free, or that anyone will hire you. An employer or other recipient remains responsible for its own decisions and legal duties. Report technical faults or disputed results to support; no guaranteed successful appeal or human pre-review of every result is promised.
B4. Permitted conduct
Do not impersonate another person, have another person perform your assessment, create multiple accounts to obtain free credits, evade limits/access controls, overload or attack the service, access other users’ data or provider credentials, or target systems outside the authorized mission environment. Security testing is permitted only to the extent expressly authorized by the mission and its isolated target. Do not publish nonpublic mission tasks, hidden checks or solutions in breach of the mission rules or another person’s rights.
Only upload content you have a lawful right to use and share. Do not place real secrets, unrelated personal data or unlawful content in a mission or CV. Review AI suggestions before accepting, executing or distributing them.
B5. Credits, payments and cancellation
The free-beta starting flow does not require a payment card. Available credits, eligible features and the cost/limits shown for a mission govern that use. Credits are service-use units; this draft does not promise cash redemption or transferability.
Conditional paid-service clause — publish only if that offering is actually enabled and its checkout disclosures are approved: prices, billing interval, taxes, renewal and cancellation terms will be presented before purchase. The owner’s existing draft proposes that paid subscription fees and credit packs are non-refundable and cancellation takes effect at the end of the paid cycle, except where mandatory law requires a refund or another remedy. Platform-fault credit adjustments follow the applicable reviewed incident process; returning credits is different from refunding money. This draft does not establish an active payment processor, automatic renewal flow, refund waiver or paid-service launch.
B6. Content, evidence and permissions
You retain the rights you hold in your submitted content and work. Third-party materials, mission assets and AI outputs remain subject to their applicable rights; we cannot promise exclusive ownership or copyright in every AI output.
Proposed contractual permission for approval: you authorize OperatorRank to host, copy, process, execute and transmit your content to the extent necessary to provide the features you request, including AI assistance, checks, storage and permitted evidence sharing, and to investigate service/security issues and meet applicable law. This permission does not authorize unrelated advertising, sale of personal data, training OperatorRank’s own models or general publication of your content. Hosting and recipients are described in A4–A5, including Hetzner FSN1, Germany, and OpenRouter/catalog-model use with training/publishing OFF. Those settings do not establish zero retention. Processing remains subject to the approved Privacy Policy and applicable legal bases. Retention after a mission follows A6; the 14-day database PITR window is not an active mission-record deletion period or an indefinite content license.
Your use of a sharing or organization-assigned feature may make the relevant evidence, selected profile information or selected CV available to its authorized recipients. Do not share material you lack permission to disclose. Do not assume a recipient’s previously obtained copy disappears when platform access ends. No general license to publish all your mission files is granted by this clause.
B7. Restrictions, ending use and requests
Access may be limited or suspended for misuse, a security problem, exhausted limits or other applicable service conditions. Where appropriate and legally permitted, we will explain the issue and how to request review through support. Immediate protective restrictions may be needed; this draft does not promise advance notice in every case.
You may stop using the service and contact support about closure or deletion. Ending access does not itself erase all records or remove a justified legal retention requirement. Applicable privacy rights and non-excludable remedies continue. No automated account-erasure completion or universal review deadline is promised here.
B8. Warranty and liability — proposed wording
Proposed text for [OWNER INPUT: LIABILITY_TEXT]; counsel must select the final wording:
During beta, the service and AI-assisted outputs are provided as available. To the extent permitted by applicable law, OperatorRank does not promise uninterrupted availability or that every output, check or result is accurate, complete or suitable for your purpose. You should review outputs and keep copies of material you need where the service permits export. Nothing in these Terms excludes or limits liability, statutory guarantees, privacy rights or remedies that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct or gross negligence where applicable. Any further exclusion of loss or monetary liability cap requires a separate, express owner and counsel decision; this draft sets no monetary cap and does not impose an indemnity.
B9. Governing law and disputes — proposed wording
Proposed text for [OWNER INPUT: GOVERNING_LAW]; not a selected jurisdiction until approved:
These Terms are governed by the laws of Thailand, subject to mandatory protections that apply to you in your country of residence. You may contact support to seek resolution of a dispute. Any court proceedings must be brought before a court with lawful jurisdiction; this clause does not remove a consumer’s right to a competent local court, require arbitration, waive collective remedies, or restrict a complaint to a regulator. Counsel must confirm the contracting entity, conflict-of-law and forum position for the approved markets.
B10. Changes and contact
We will publish the approved Terms and effective date and provide the notice/acceptance process required for material changes. For support, result review, privacy requests or a dispute, email support@operatorrank.com through the Cloudflare Email Routing path described in A1. Review note: approve the version, effective date and both languages together; no retroactive change or automatic consent to optional data use is implied.
